Terms of Service
Effective date: October 1, 2026
These terms govern use of Jury Manager, the jury-management service at jurymanager.com ("the Service"), provided by Jury Manager ("we," "us"). By creating an account, signing in, or using the Service, the court you work for ("the Court," "you") agrees to these terms. If the Court has signed a separate written agreement with us, that agreement controls where the two conflict.
1. Who may use the Service
The Service is for courts and the people they authorize: clerks, court administrators, and, for trial-day access, judges and attorneys. A Court Administrator at each court decides who gets a login and what role they have. You may not use the Service if you are not authorized by a court, except to use the public juror portal as a juror.
2. Accounts
- Keep your login credentials private. Each person uses their own login; do not share accounts.
- The Court is responsible for everything done under its users' logins, and for removing access when someone leaves.
- Tell us promptly at info@jurymanager.com if you believe an account has been compromised.
- Demo accounts are for evaluation with sample data only and may be disabled at any time.
3. The Court's data
Juror records, questionnaires, letters, messages, and reports the Court puts into or generates with the Service belong to the Court. We process that data only to provide the Service and as described in our Privacy Policy. The Court confirms it is authorized to load its jury source list and juror information into the Service, and is responsible for the accuracy of what it enters.
The Court is responsible for complying with the jury statutes and court rules that apply to it, including the wording of its summons and letters, the attestation language on questionnaires, retention of records, and any required notices to jurors. The Service provides tools; it does not provide legal advice.
4. Text messages and email
The Service can send text messages and email to jurors on the Court's behalf. The Court is responsible for having an appropriate basis to contact jurors by those channels under the laws that apply to it, and for the content of messages it sends. Text messages are delivered through a shared toll-free number; standard carrier rates may apply to jurors. A juror who replies STOP will no longer receive texts through the Service.
5. Acceptable use
You agree not to:
- Access or attempt to access another court's data, or any part of the Service you are not authorized to use.
- Load information into the Service that you do not have the right to use.
- Probe, scan, scrape, or load-test the Service, or try to defeat the public portal's rate limits or signed links.
- Use the Service to send unsolicited or unlawful messages, or for any purpose other than jury management.
- Resell, sublicense, or provide the Service to a third party.
6. Fees
Fees, the subscription term, and any per-name charges are set out in the Court's written quote, order, or invoice. Subscriptions are billed annually in advance unless the order says otherwise. Fees are non-refundable except where the order or the law says so.
7. Availability and support
We work to keep the Service available at all times, but it may be interrupted for maintenance, updates, outages at our hosting or messaging providers, or events outside our control. We will try to schedule planned maintenance outside court hours and give notice when we can. Support is provided by email and phone during business hours in the Pacific time zone.
8. Third-party services
The Service relies on third-party providers for hosting, text messaging, email delivery, and driving-distance calculation, as listed in the Privacy Policy. Those providers' availability and terms are outside our control. Driving distances come from a mapping provider and are estimates; the Court should review them before use in jury pay.
9. Our intellectual property
The Service, including its software, design, templates, and documentation, is owned by us and protected by copyright and other laws. The Court gets a non-exclusive, non-transferable right to use the Service during its subscription. Nothing in these terms transfers ownership of the Service to the Court, or of the Court's data to us.
10. Disclaimer of warranties
The Service is provided "as is" and "as available." We do not promise that it will be error-free or uninterrupted, or that it will meet every requirement of every court. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost revenue, arising from use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the fees the Court paid us in the twelve months before the event giving rise to the claim.
12. Term, termination, and return of data
These terms apply for as long as the Court has an account. Either side may end the subscription at the close of the current term with written notice. We may suspend or end access immediately if these terms are seriously breached or if required by law. For thirty days after a subscription ends, the Court may export its data from the Service; after that period we delete the Court's data from active systems as described in the Privacy Policy.
13. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and notify customer courts by email of material changes at least thirty days before they take effect. Continued use after that date means the Court accepts the new terms.
14. Governing law
These terms are governed by the laws of the State of Washington. Any dispute will be brought in the state or federal courts located in Washington, and both sides consent to their jurisdiction.
